Former Fulham midfielder turned lawyer, Udo Onwere, has described the ongoing legal dispute between football players and Fifa as a "seismic confrontation." The controversy stems from a compensation claim initiated by the Dutch foundation Justice for Players (JFP) on behalf of current and former professional footballers against Fifa and several European football associations.
JFP has launched a class action lawsuit against Fifa, along with the football associations of France, Germany, the Netherlands, Belgium, and Denmark, arguing that around 100,000 footballers in Europe since 2002 may have suffered financial losses due to what they deem as "unlawful" regulations by Fifa. The damages claimed could potentially reach billions of pounds.
The legal battle was triggered by a ruling from the European Court of Justice (CJEU) last year, favoring former Chelsea and Arsenal midfielder Lassana Diarra. Diarra had contested that certain Fifa rules infringed on his freedom of movement and competition laws, leading to his successful lawsuit against Fifa.
Udo Onwere, now a partner at law firm Bray and Krais, believes that this class action lawsuit could revolutionize the regulations concerning player mobility in the football industry. Drawing parallels to the groundbreaking 1995 Bosman ruling, Onwere suggests that this legal confrontation could bring about significant changes in transfer regulations and governance, balancing contractual stability with player autonomy.
JFP's legal counsel, Jean-Louis Dupont, who was also involved in the 1995 Bosman case, is advising the foundation in this current legal dispute. The outcome of this case could potentially allow players to terminate their contracts without compensation before they expire, altering the dynamics of player transfers in football.
Fifa has been given until the beginning of September to respond to the legal threat posed by JFP's lawsuit. The implications of this legal battle could reshape the football industry, potentially impacting player contracts and transfer rules in the future.
